Certiff B.V. – Terms of Service

– “Services” refers to the HR matchmaking services provided by Certiff B.V. through its website and platform.
– “User,” “you,” or “your” refers to any individual or entity using Certiff’s services.

2. Use of Services

2.1 Eligibility: By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2.2 Account Creation: In order to use our services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3 User Responsibilities: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Privacy

3.1 Privacy Policy: Your use of our services is also subject to our Privacy Policy. By using our services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

4. Service Usage

4.1 Matchmaking Services: Our platform facilitates HR matchmaking between job seekers and potential employers. We do not guarantee job placement, and we are not responsible for the outcome of any interactions or transactions that may occur between users.

4.2 User Content: Any content you submit or upload to our platform, including resumes, job postings, and communications, remains your property. However, you grant Certiff a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of providing our services.

5. Prohibited Activities

You agree not to engage in any of the following activities while using our services:

• Violating any applicable laws, regulations, or ordinances.
• Impersonating any person or entity or falsely representing your affiliation with a person or entity.
• Posting false, misleading, or fraudulent information.
• Harassing, intimidating, or threatening other users.
• Uploading viruses, malware, or any other malicious code.
• Attempting to gain unauthorized access to our systems or networks.

6. Termination

6.1 Termination by You: You may terminate your account at any time by following the instructions provided on our platform.

6.2 Termination by Certiff: We reserve the right to terminate or suspend your account and access to our services at our sole discretion, without prior notice, for any reason, including if we believe you have violated these Terms.

7. Limitation of Liability

To the maximum extent permitted by Dutch law, Certiff B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our services.

8. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our platform. Your continued use of our services after the posting of any changes constitutes your acceptance of those changes.
